Formulaires obligatoires : Form 8949 (chaque transaction Part I short-term + Part II long-term), Schedule D (aggregate totals), NEW Form 1099-DA 2026 (exchanges report proceeds + cost basis), FBAR FinCEN 114 si crypto exchanges étrangers >$10K (US persons only).

- Form 1040 (individuals)
- Form 1040-SR (seniors)
- Form 1040-NR (non-resident aliens)
- Form 1041 (estates and trusts)
- Form 1065 (partnerships)
- Form 1120 (corporations)
- Form 1120-S (S-corporations)
Mentir = perjury + audit risk élevé. Toujours répondre vérité.
Form 8949 structure (Part I short-term + Part II long-term)#
Le Form 8949 (Sales and Other Dispositions of Capital Assets) liste chaque transaction crypto individuellement.
Structure Form 8949#
| Part | Holding period | Tax treatment |
|---|---|---|
| Part I | Short-term (≤12 mois) | Ordinary income rate 10-37 % |
| Part II | Long-term (>12 mois) | Qualified rate 0/15/20 % |
Colonnes Form 8949#
| Colonne | Détail |

| (a) Description property | Ex « 0.5 BTC » |
| (b) Date acquired | MM/JJ/YYYY |
| (c) Date sold | MM/JJ/YYYY |
| (d) Proceeds (sale price) | $ USD |
| (e) Cost basis (purchase price) | $ USD |
| (f) Code if any | Code adjustment (rare crypto) |
| (g) Amount adjustment | $ adjustment (rare) |
| (h) Gain/loss | Calculé = (d) - (e) + (g) |
Citation CoinLedger officielle#
« In the United States, crypto is taxed as income and capital gains. How your crypto is taxed and reported depends on the nature of your income. If you dispose of crypto-assets, such as selling them, trading them away, or using them to make a purchase, you should report your disposal on Form 8949. Then, your net gain/loss should be reported on Schedule D. » — CoinLedger
Cas chiffré Form 8949#
Trader achète 1 BTC à $30 000 le 15 janvier 2025, vend pour $50 000 le 15 février 2025 (short-term holding 1 mois).
| Colonne | Valeur |
|---|---|
| Description | 1.0 BTC |
| Date acquired | 01/15/2025 |
| Date sold | 02/15/2025 |
| Proceeds | $50 000 |
| Cost basis | $30 000 |
| Gain | $20 000 (short-term) |
Tax : $20 000 × 32 % (bracket fed) = $6 400 tax.
Si même trade mais HODL >12 mois (sell 02/15/2026) : long-term qualified rate 15 % = $20 000 × 15 % = $3 000 tax. Économie HODL : $3 400.
Schedule D aggregate gains/losses#
Structure Schedule D#
| Section | Contenu |
|---|---|
| Part I | Short-term capital gains/losses (aggregate Form 8949 Part I) |
| Part II | Long-term capital gains/losses (aggregate Form 8949 Part II) |
| Part III | Summary : net short + long + carryover losses |
| Line 16 | Total net capital gain/loss reported on Form 1040 line 7 |
Capital loss carryover#
Si Schedule D génère net capital loss :
- Max $3 000 deductible par année contre ordinary income ($1 500 si married filing separately)
- Excess carried forward indéfiniment vers années futures
- Tracking via Schedule D Capital Loss Carryover Worksheet
Cas pratique#
Trader 2025 :
- Short-term gains (Part I) : $50 000
- Long-term gains (Part II) : $30 000
- Total net capital gain : $80 000
Tax calculation :
- Short-term $50K × 32 % bracket = $16 000
- Long-term $30K × 15 % qualified rate = $4 500
- Total tax 2025 : $20 500
Form 1099-DA NEW 2026 (exchanges report)#
Application Form 1099-DA#
- Brokers/exchanges crypto (Coinbase, Kraken, Binance.US, Gemini, Crypto.com, etc.)
- Doivent report gross proceeds + transaction details à l'IRS pour chaque vente crypto utilisateur
- Issued aux utilisateurs annuellement (deadline 31 janvier N+1)
- Copie automatique envoyée IRS
Phases déploiement#
| Tax year | Phase | Reporting required |
|---|---|---|
| 2025 | Phase 1 | Proceeds (sale price) seulement |
| 2026 | Phase 2 | Proceeds + cost basis + gain/loss data |
Conséquence utilisateurs#
L'IRS reçoit automatiquement vos données crypto via 1099-DA = matching auto avec votre Form 8949. Si discrepancy 1099-DA vs Form 8949 = audit risk élevé.
Solution : conserver votre propre tracking via CoinLedger/Koinly et override 1099-DA si incorrect via Form 8949 Code « B » (Basis reported on 1099-B but not correct).
Capital gains rates 2026 (short vs long-term)#
Les capital gains rates 2026 varient selon holding period.
Short-term rates (≤12 mois)#
Taxé ordinary income rate selon bracket fiscal personnel :
| Bracket 2026 | Income range single | Rate |
|---|---|---|
| 10 % | $0-11 925 | 10 % |
| 12 % | $11 925-48 475 | 12 % |
| 22 % | $48 475-103 350 | 22 % |
| 24 % | $103 350-197 300 | 24 % |
| 32 % | $197 300-250 525 | 32 % |
| 35 % | $250 525-626 350 | 35 % |
| 37 % | $626 350+ | 37 % |
Long-term rates (>12 mois) — qualified rate#
| Rate | Income range single 2026 |
|---|---|
| 0 % | $0-48 350 |
| 15 % | $48 350-533 400 |
| 20 % | $533 400+ |
NIIT (Net Investment Income Tax) supplémentaire#
US persons high earners (income >$200K célibataire) : +3.8 % NIIT sur tous capital gains. Conséquence : long-term effective rate = 18.8 % (15 + 3.8) ou 23.8 % (20 + 3.8).
Stratégie HODL#
HODL >12 mois avant sale = économie significative. Cas chiffré : trader $100K capital gains, tax bracket 32 % federal :
- Short-term (sale <12 mois) : $100K × 32 % = $32 000 tax
- Long-term (HODL >12 mois) : $100K × 15 % = $15 000 tax
- Économie HODL : $17 000
Pour LLC USINCO francophone non-résident Non-ETBUS#
Aucun capital gains tax fédéral US (Article 7 Convention attribue gains au pays résidence). Mais impôt France/Belgique/Suisse applicable selon résidence. Voir notre guide convention France-USA.
